Mlynek and Tiedemann Tame Two Juries in One Week |
|
The litigation team of Steve Tiedemann and Rich
Mlynek tried two jury trials in one week in
Baltimore City and won both! This rare scheduling
occurrence tested the tenacity of the firm's
attorneys and the teamwork of our entire staff. The
cases involved questions of fraud during the sale of
property as well as breach of contract for a
property transaction. The juries returned verdicts
for the firm's clients for 100% of the amount asked
for in closing arguments. At this time, the Courts
are reviewing petitions asking for the reimbursement
of our clients' attorneys fees.

Family Law Successes |
|
Recently, Fred "Chip" Coover successfully
finished four days of a five day divorce/custody
trial. Family law trials of that length are not
common, but when they do occur, Chip flourishes.
Also, Steve Tiedemann was recently successful in
gaining an emergency order returning custody of
a child to a Pennsylvania mother when the child
was not returned by the Maryland father after
visitation. Although no client wants to endure a
family law problem, CB&T's trained litigators
stand ready to help.

Divorce Law Update - Personal Property Transfers |
|
As of October 1, 2004, forced sale of family
used personal property items, like your
cherished recreational-use only beat up Jeep, is
no longer the only way to get an equitable
distribution during a divorce. Thanks to the
newly revised Section 8-205, Family Law Article,
courts are now authorized to transfer possession
of family use personal property (motor vehicles,
furnishings, furniture and household
appliances). Before the law changed, courts
could only award use and possession of such
personal property for three years from date of
divorce. If there was a dispute, the court's
only recourse was to order the personal property
sold and the funds thereof divided. Obviously,
being forced to sell candlesticks, chairs or
cars is not the best use of the limited
resources many families bring to court. These
items rarely have great market value and are
usually expensive to replace. This makes
personal property items a frequent obstacle to
settlement due to their use as negotiating
tools. This change in the law will enable courts
to resolve disputes over property in a manner
that will promote agreements between parties and
allow divorcing spouses to keep the things that
matter to each party. For example, the courts
can now transfer that jointly-owned Jeep to the
spouse that really cares about it! If you need

Barr Brings About Bus Service |
|
John Barr is assisting the Towns of Colmar Manor,
Cottage City and Bladensburg (Port Towns of Prince
George's County) in creating an on-call bus service
to serve senior citizens and deserving individuals
and groups within the respective towns.
The bus service, which was created by Colmar Manor
with assistance from the Prince George's County
Government, has operated for many years serving the
citizens of its town. The Port Towns now seek to
create a Memorandum of Understanding between each
town to provide the same on-call bus service to all
of their communities.
